Welcome to Phova, operated by truethinks ltd. These Terms of Service ("Terms") govern your use of the Phova mobile application and related services ("Service"). By using Phova, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using Phova, you confirm that you are at least 13 years old and that you accept these Terms. If you do not agree, do not use the Service.
2. Description of Service
Phova is an AI-powered photo and video transformation application. You may upload a photo, choose a transformation style, and receive an AI-generated output. The Service relies on third-party AI providers (Wiro AI, ByteDance Seedream, Kling AI, and others).
3. Account and Credits
Anonymous accounts. You can use Phova without registering via an anonymous device-based account.
Registered accounts. You may create an account with an email address to sync your usage across devices.
Credits. Transformations consume credits. New users receive a complimentary credit balance. Additional credits may be purchased via in-app purchase. Credits:
- Have no monetary value and are non-refundable except as required by law
- Cannot be transferred between accounts
- May expire after prolonged account inactivity
4. Acceptable Use
You agree not to use Phova to:
- Create content depicting real people without their consent (no deepfakes of identifiable individuals)
- Generate sexually explicit content involving minors or non-consenting individuals
- Create content that is illegal, defamatory, hateful, harassing, or promotes violence
- Attempt to impersonate another person for fraudulent purposes
- Reverse-engineer, scrape, or automate the Service
- Upload photos you do not have the right to use
- Violate any applicable law or regulation
We reserve the right to suspend or terminate accounts that violate these rules.
5. AI-Generated Content
AI-generated outputs are produced by third-party models and may be imperfect, unexpected, or produce unintended results. You acknowledge that:
- AI outputs may not match your exact intent
- Credits consumed for a transformation are generally non-refundable, even if the output is unsatisfactory (we may, at our discretion, refund credits for clearly failed transformations)
- You are solely responsible for how you use the outputs
6. Intellectual Property
Your content. You retain ownership of the photos you upload. By using the Service, you grant truethinks ltd a limited, worldwide, royalty-free license to process your content solely for the purpose of providing the Service.
AI outputs. To the extent allowed by law, you own the outputs generated from your inputs. Note that AI-generated content may not be eligible for copyright protection in some jurisdictions.
Phova brand. The Phova name, logo, and app design are the property of truethinks ltd and may not be used without written permission.
7. Subscriptions and Refunds
If you purchase credits or a subscription through the Apple App Store or Google Play, the respective store's billing terms apply. Refund requests should be submitted through the store:

- Google: play.google.com/store/account/subscriptions

8. Account Deletion
You can delete your account at any time from the profile screen. Deletion removes your account and associated data from our servers within 30 days, except where we are required by law to retain certain information.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUETHINKS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced within the app. Continued use of the Service after changes indicates your acceptance.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, without prejudice to mandatory consumer protection rights in your country of residence.
